Product Terms of Service

1. About these terms

These terms govern your use of Atrophy software application (the "Software"), developed by Will Lilley ("we", "us", "our"). By downloading, installing, or using the Software, you agree to these terms. If you don't agree, don't use the Software.

These terms apply to the Software itself. The website at atrophy.app is governed by separate Website Terms of Use.

2. What the Software is

Atrophy is a companion agent application that runs locally on your Mac. It provides conversational AI, memory, voice synthesis, scheduling, and integration with optional third-party services.

The Software is experimental. It is a personal project provided to the public. It is not a commercial product backed by a company, a support team, or a service-level agreement.

3. Licence

The Software is provided under the terms of its open-source licence as specified in the source repository at github.com/wlilley93/Atrophy. Your use of the source code is governed by that licence.

Pre-built application bundles (DMGs) are provided for convenience. The same licence terms apply.

4. No warranty - seriously

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, OR ACCURACY.

WITHOUT LIMITING THE FOREGOING, WE EXPRESSLY DISCLAIM ANY WARRANTY THAT:

  • The Software will meet your requirements or expectations
  • The Software will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Software will be accurate, reliable, or complete
  • Any errors in the Software will be corrected
  • The Software is free of viruses or harmful components
  • The Software will not cause damage to your system, data, or files
  • The Software's AI-generated content will be accurate, appropriate, safe, or fit for any purpose

Plain English: This is experimental software built by one person. It will have bugs. It may break. AI outputs are unpredictable. Do not rely on it for anything critical.

5. AI-generated content disclaimer

The Software uses AI models (including Claude by Anthropic) to generate text, make decisions, and take actions. You acknowledge and agree that:

  • AI output is not advice. Nothing the Software produces constitutes legal, medical, financial, psychological, or professional advice of any kind.
  • AI output may be wrong. Large language models hallucinate, confabulate, and produce incorrect information. Do not rely on AI-generated content without independent verification.
  • AI output may be offensive. Despite safety measures, AI models can produce unexpected, inappropriate, or harmful content. We are not liable for any AI-generated content.
  • AI actions may be unintended. The Software can autonomously send emails, create calendar events, send Telegram messages, and take other actions on your behalf. These actions may be incorrect, poorly timed, or unwanted.
  • You are responsible for AI actions taken on your behalf. If the Software sends an email, creates a calendar event, or takes any other action using your accounts, you bear full responsibility for those actions.

6. Third-party services

The Software integrates with third-party services that you optionally configure:

We are not responsible for third-party services. We do not control, endorse, or guarantee the availability, accuracy, security, or legality of any third-party service.

API keys and credentials. You are responsible for the security of your API keys and credentials. While the Software stores credentials with restricted file permissions, we make no guarantee against unauthorised access.

Third-party service changes. Third-party services may change their APIs, terms, pricing, or availability at any time. We are not obligated to update the Software to maintain compatibility.

7. Google integration - specific disclaimers

If you authorise Google access, the Software accesses your Gmail and Google Calendar using OAuth2 tokens stored on your machine. You acknowledge that:

  • The Software can read your email including sensitive or confidential information.
  • The Software can send emails on your behalf. Emails sent by the AI agent come from your Google account.
  • The Software can create, modify, and delete calendar events.
  • Email and calendar content is processed locally by AI models via third-party inference APIs.
  • Prompt injection risk. Email bodies may contain malicious content designed to manipulate AI behaviour. No defence is perfect.
  • You can revoke access at any time by running python scripts/google_auth.py --revoke or at myaccount.google.com/permissions.

8. Data and privacy

The Software runs locally on your machine. We do not collect, transmit, or store your data on any server. See our Privacy Policy for details.

9. Autonomous actions

The Software can act autonomously - sending messages, creating events, firing notifications, running scheduled tasks, and modifying its own prompts. You consent to autonomous actions by enabling the relevant features.

10. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED £50 GBP.

11. Indemnification

You agree to indemnify, defend, and hold harmless Will Lilley from and against any claims arising from your use of the Software or actions taken by the Software on your behalf.

12. Age restriction

The Software is not intended for use by anyone under the age of 18.

13. Governing law

These terms are governed by the laws of England and Wales.

14. Changes to these terms

We may update these terms at any time. Material changes will be noted in release notes.
