These terms govern your use of Atrophy software application (the "Software"), developed by Will Lilley ("we", "us", "our"). By downloading, installing, or using the Software, you agree to these terms. If you don't agree, don't use the Software.
These terms apply to the Software itself. The website at atrophy.app is governed by separate Website Terms of Use.
Atrophy is a companion agent application that runs locally on your Mac. It provides conversational AI, memory, voice synthesis, scheduling, and integration with optional third-party services.
The Software is experimental. It is a personal project provided to the public. It is not a commercial product backed by a company, a support team, or a service-level agreement.
The Software is provided under the terms of its open-source licence as specified in the source repository at github.com/wlilley93/Atrophy. Your use of the source code is governed by that licence.
Pre-built application bundles (DMGs) are provided for convenience. The same licence terms apply.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, OR ACCURACY.
WITHOUT LIMITING THE FOREGOING, WE EXPRESSLY DISCLAIM ANY WARRANTY THAT:
Plain English: This is experimental software built by one person. It will have bugs. It may break. AI outputs are unpredictable. Do not rely on it for anything critical.
The Software uses AI models (including Claude by Anthropic) to generate text, make decisions, and take actions. You acknowledge and agree that:

We are not responsible for third-party services. We do not control, endorse, or guarantee the availability, accuracy, security, or legality of any third-party service.
API keys and credentials. You are responsible for the security of your API keys and credentials. While the Software stores credentials with restricted file permissions, we make no guarantee against unauthorised access.
Third-party service changes. Third-party services may change their APIs, terms, pricing, or availability at any time. We are not obligated to update the Software to maintain compatibility.
If you authorise Google access, the Software accesses your Gmail and Google Calendar using OAuth2 tokens stored on your machine. You acknowledge that:

The Software can act autonomously - sending messages, creating events, firing notifications, running scheduled tasks, and modifying its own prompts. You consent to autonomous actions by enabling the relevant features.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED £50 GBP.
You agree to indemnify, defend, and hold harmless Will Lilley from and against any claims arising from your use of the Software or actions taken by the Software on your behalf.
The Software is not intended for use by anyone under the age of 18.
These terms are governed by the laws of England and Wales.
We may update these terms at any time. Material changes will be noted in release notes.
